1. Agreement to Terms

By accessing or using the website MontanaGoldClaims.com (the "Site"), or by purchasing or expressing interest in any of our mineral claims, services, or information, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all other policies and guidelines posted on the Site. If you do not agree with all of these Terms, you are expressly prohibited from using the Site and must discontinue use immediately.

Montana Gold Claims (operated by Marlene A. Affeld, Oregon Gulch Exploration) offers information about, and facilitates the sale and transfer of, unpatented federal lode and placer mining claims in Mineral County, Montana. Our services include providing due diligence reports, geological information, historical data, and facilitating the transfer of ownership of these claims.

3. Use of the Site and Content

4. Mineral Claim Sales and Transfers

• Binding Agreements: Any offer, sale, or transfer of a mineral claim will be subject to a separate, formal, written Purchase and Sale Agreement, which will supersede these Terms regarding the specific transaction.

• "As-Is" Basis: All mineral claims are offered and sold on an "as-is, where-is" basis, with all faults, and without any warranties or representations of any kind, whether express or implied, regarding their condition, merchantability, fitness for a particular purpose, or the existence or quantity of any minerals.

• Risk Assumption: The purchaser expressly acknowledges and agrees to assume all risks associated with mineral exploration, development, and mining, including but not limited to geological risks, market price fluctuations, environmental regulations, operational costs, and changes in law or policy.

• No Implied Title Warranty: While we strive to provide clear title to unpatented claims, unpatented mining claims are federal possessory interests subject to valid existing rights and ongoing maintenance requirements with the BLM and county. We do not provide title insurance or legal guarantees of patentable title. Purchasers are advised to conduct their own title due diligence.

5. Intellectual Property Rights

Unless otherwise indicated, the Site and all content, including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content"), and the trademarks, service marks, and logos contained therein (the "Marks"), are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. No part of the Site or Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE’S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THIS SITE.

8. Limitation of Liability

10. Governing Law

These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of law principles.

11. Modifications to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms, and you waive any right to receive specific notice of each such change. Your continued use of the Site after such changes constitutes your acceptance of the revised Terms.

12. Miscellaneous

These Terms of Service and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Service shall not operate as a waiver of such right or provision.
